What services are included
The work will involve:
- Discussing your circumstances in detail and confirming whether this is the most appropriate application for you to make and what other options may be available to you.
- Giving you advice about the requirements of the Immigration Rules and whether you meet the criteria.
- If you do not fulfil certain criteria, whether this can be overcome and how, which on average takes three hours.
- Considering the supporting evidence, you have provided, which we anticipate will take two to three hours.
- Where necessary, helping you obtain further evidence (such as medical records and bank statements), including taking statements of any witnesses.
- Preparing your application and submitting it on your behalf, which we anticipate will take two hours.
- Attendance at a Home Office interview: if the Home Office ask you to attend an interview, we will give you clear advice (and discuss the possibility of us attending with you) at the appropriate time. This could be between two and three hours of work.
- Giving you advice about the outcome of the application and any further steps you need to take.
The number of hours depends on the number of documents, whether they need to be translated, whether anything is missing and how long it will take to obtain the missing documents.
The costs quoted here do not include:
Any Home Office fees for making the application. You will pay this to the Home Office directly as part of the application process.
VAT: VAT applies in cases where people already have Leave to Remain in the UK. This should be added to our figures at 20%. If you are making an initial application for Leave, VAT is not applicable.
Where the Home Office refuse your application, advice, and assistance in relation to any appeal
Disbursements (not included in costs set out above)
As the government fees continue to change so we will advise you at the outset of all UKVI / Home Office fees relevant to your application and the Home Office publishes a comprehensive list of their application fees which it would not be appropriate to publish here, but which can be accessed here. https://www.gov.uk/government/publications/visa-regulations-revised-table
Please note, the list does not include the Immigration Health Surcharge which we will calculate according to your personal circumstances and include among the disbursements payable.
In addition, where counsel opinion / expert report / translation and / or interpretation services are required, we will provide you with a quote for you to consider before we engage the third parties.
Please further note that the disbursement as set out do not include VAT (20%) and if VAT (20%) is payable, we will clearly set this out from the outset so that the costs are clear.
How long will my application take?
We cannot guarantee how long the Home Office will take to process your application. Read the current processing times.
We will normally be able to submit this type of application within two weeks of you instructing us, but we will let you know at the earliest opportunity if it is likely to take longer than this.
Please note the anticipated number of hours and fees are an estimate based on the facts above. All applications are likely to vary and of course, we can give you a more accurate estimate once we have more information about your specific case.
Typical timescales and key stages
In our experience the vast majority of out of country applications are decided within 8-12 weeks, although some family-based applications can take longer (up to 12-24 weeks).
Processing times for in-country applications can vary depending on whether they are submitted as standard (up to six months, though usually no more than 3 months) or priority (within 7-10 days, with payment of an additional Home Office fee).
Please remember the above timescales are subject to change depending on the decision maker’s schedule.
